The hearing is currently set for July 11, but Bam says Nikki is not allowing him to see his son, wonder … That’s why he wants the judge to intervene and take action as soon as possible.
TMZ broke the story … Nikki filed for legal separation back in February, citing irreconcilable differences and seeking legal and physical custody over Phoenix as well as spousal support.
In his emergency filing, Bam is also claiming that he was not legally married to Nikki in the first place.
Nikki also filed legal documents obtained by TMZ claiming there was no reason to recall everyone before the judge. Nikki says she is following the custody orders and Bam is still able to see their child.
At the docs, Nikki shadows Bam… she says he can see his son, as long as he’s in California and not under the influence.
nikki’s lawyer david glasstells TMZ… “Mr. Margera continues to claim to be the ‘injured’ party because he is not seeing Phoenix — even though he himself after exposing her to child abuse and drug/alcohol abuse 3000 miles away.”
For his part, Bam claimed that he swore to drink For the sake of my son.
