Kesha delighted fans with a topless photo

She is in the midst of a legal battle with her former music producer Dr. Luke.

Still, Kesha enjoyed a little relief on Thursday as she treated her fans to a topless photo on Instagram.

The 35-year-old singer teased her incredible figure as she posed with her back to the camera as she looked out over a countryside view.

The Take It Off hitmaker showed off her tattoos in the photo, where she posed naked except for a cowboy hat.

Kesha also shared two striking selfies, a throwback with her blonde locks and a recent photo with her brunette locks.

Her sultry post comes after she accused Dr Luke and his legal team of delaying ahead of their long-awaited defamation trial.

Singer Leah Godeski’s attorney filed a new filing with a New York judge earlier this month, expressing concern that the trial could be in jeopardy if Kesha’s two pending appeals remain unresolved.

“Kesha has a vested interest in the trial proceeding as scheduled on February 20, 2023, not only so that she can seek rehabilitation, but also so that she can put this ordeal behind her and move on with her life,” Godeski wrote in documents received from A rolling stone.

Kesha’s lawyer said the Tik Tok hitmaker is “eager” to face her former collaborator in court next year and is actively seeking “expedition of the proceedings at the Court of Appeal”.

Attempts by Kesha to speed up the briefing deadlines so that oral arguments in both appeals could be heard in October or November this year were rebuffed by Dr. Luke and his legal team.

“Therefore, Kesha has done everything in her power to try to ensure that the trial starts on schedule, including trying to speed up the proceedings at the Court of Appeal. Dr. Luke thwarts her efforts at every turn,” Godeski wrote.

Although Dr. Luke’s lead attorney recently stated in a letter to the judge that her client is “ready and willing to proceed with the process” of Kesha’s two pending appeals, Godeski firmly stated that “the process cannot proceed without the resolution of these problems.

“It would be a colossal waste of partisan and judicial resources to proceed with a trial when there is a very real risk of an immediate new trial, as would be the case if the Court of Appeals overturned any of the several issues currently before it.”

“Prompt resolution of pending appeals is essential before the trial can begin.”

One of Kesha’s pending appeals concerns a previous ruling that Dr. Luke is considered a private and not a public figure.

That means he and his legal team will only have to prove that Kesha acted negligently, but not with actual malice, when she made her allegations of misconduct.

Her second appeal is over an appeals court ruling earlier this year that she can’t sue Luke (real name Lukasz Sebastian Gottwald) for her attorney’s fees.

Kesha received a motion from a judge in late June 2021 that allowed her to retroactively apply a New York free speech law to make Dr. Luke pay her legal fees, although he appealed that decision a month later.

New York’s Free Speech Act was passed in an attempt to limit lawsuits brought by the rich and powerful to stifle free speech.

Manhattan Supreme Court Justice Jennifer Schecter agreed that the New York law can be applied retroactively to Kesha and Dr. Luke’s lawsuit, while she granted Kesha’s request to file counterclaims against Dr. Luke and will make Dr. Luke liable for her legal fees if she wins the defamation case.

The producer appealed the decision in July, with a judge ruling in his favor in March 2022.

The judge said that when the free speech law was amended in 2020, it “did not specify that the new legislation should be applied retroactively”.

In response to a letter sent to Rolling Stone by Dr. Luke’s lawyers on Tuesday, they hit back at Kesha’s claims, saying the pop star’s lawyers were responsible for delays in legal proceedings over the years.

They also mentioned the letter recently sent to the judge two weeks ago regarding their client’s alleged “desire” to continue, but with the star’s appeals still pending.

“As is clear from our own letter to the court, Dr. Luke is ready and willing to try the case in February and looks forward to winning the trial,” the producer’s team wrote on Tuesday.

“Kesha’s lawyers are the ones who have delayed the case for years by endlessly filing frivolous appeals that they lose time and time again. If the case doesn’t go to trial in February, it will only be because Kesha’s lawyers have once again decided to appeal more — this time two decisions that again ruled against her in the Appellate Division.

The legal battle first began in October 2014, when Kesha sued Dr. Luke for sexual assault and battery and claimed his abusive behavior led to her developing an eating disorder.

The singer claimed that Dr. Luke drugged and raped her back in 2005, and in 2016 she publicly accused him of raping singer Katy Perry.

Dr. Luke immediately fired back with his own defamation lawsuit, claiming that Kesha had defamed him with her false claims when she said in a message to Lady Gaga that Dr. Luke had raped Katy Perry.

Perry denied that Dr. Luke raped her in her testimony, and the judge ruled that Kesha had defamed her former producer.

The judge also ruled that Kesha must pay Dr. Luke $373,000 in interest for her late payment to him of over $1.3 million in royalties.
